According to court records, Paul claims he was denied the opportunity to verify the floor’s authenticity before Heritage demanded payment, originally due on Sept. 25. The records state that Heritage warned him he would forfeit his rights to the floor if he missed the deadline. As per Paul's counsel, Josh Bernstein of Akerman LLP, Paul requested a temporary restraining order and a temporary injunction against Heritage Auctions. The TRO was granted Thursday morning, and a hearing on the injunction is scheduled for Oct. According to WFAA, a spokesperson for Heritage said Paul's claims will not hold up in court. "Heritage Auctions does not believe that the buyer has any merit to their claims, and we stand behind every item that we sell," Heritage Auctions said in a statement to WFAA. Paul's lawsuit seeks a temporary restraining order to prevent Heritage from canceling the sale, reselling the item, or returning it to the consignor.
